1. Acceptance of conditions

The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen or on paper and expressly declares accepting them without reservation.
These general terms and conditions of sale govern the contractual relationship betweenMenilmontant AP and its customer, and are accepted unreservedly by both parties.
These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.

The photographs illustrating the products are not contractually binding.
In the event of errors,Menilmontant AP cannot be held responsible. Always refer to the product name.

1. Control

1. Delivery

Delivery will be made by carrier, so the customer agrees to provide an address where it will be available during the day for delivery against signature.

In the event of apparent defects, the buyer benefits from the right of return under the conditions set out in this document.
Always check your parcel on arrival. You have 48 hours to make any reservations with the carrier in the event of shortage or damage.

1. Withdrawal

You have 14 days (from receipt of the items) to make up your mind.
In the event of an exchange or refund, return the item(s) in their original packaging, undamaged and unused, together with any accessories, instructions and documentation, to the following address:

In the event of exercising the right of withdrawal,Menilmontant AP is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the cost of return, which remains at the customer's expense. Reimbursement is due within a maximum of 15 days.

1. Price

The price is expressed in euros.
The price indicated on the product sheets does not include transport.
The price indicated in the "basket" order confirmation is the final price, inclusive of all taxes and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs, transport and commissioning costs.

1. Payment

The price of the products is payable in cash on the day the order is placed.
Payment is made by credit card, online via a bank server in a secure environment.
The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval.
In the event of refusal by the said centers, the order will be automatically cancelled and the customer will be informed by e-mail.
Furthermore,Menilmontant AP reserves the right to refuse any order from a customer with whom a dispute exists.

1. Disputes

This contract is governed by French law. L'ADAP cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products sold. The same applies to any product modifications resulting from manufacturers. In any event,Menilmontant AP' s liability shall be limited to the amount of the order, andMenilmontant AP shall not be held liable for any errors or omissions despite the precautions taken in the presentation of the products. In the event of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, of seeking an amicable solution, notably with the help of :
* an industry trade association
* a consumer association or any other advisor of his/her choice.

It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the purchaser honors his financial commitments to the seller.
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company for an amicable solution at :

1. Property

Menilmontant AP retains ownership of the products ordered until'effective and full payment.égral of the order.
The customer becomes responsible for the productès réception.
A déof payment,Menilmontant AP may demand by registered letter with acknowledgement of receipt the return of the articles at the customer's expense.

1. Warranty

All products sold on contact@musicframelab.com are new and guaranteed for at least one year according to the rules defined by the manufacturers.
In all cases,Menilmontant AP may not be held responsible for non-compliance with regulatory and legislative provisions in force in the country of reception. The liability ofMenilmontant AP is systematically limited to the value of the product in question, at the date of sale.
In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). Provided that the buyer can prove the hidden defect, the seller is legally bound to repair all the consequences (art.1641 et seq. of the French Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the French Civil Code). Menilmontant AP will bear the cost of returning the product toMenilmontant AP in the event of a warranty claim, if and only if the manufacturer acknowledges the product's defect. This offer is valid only for metropolitan France, and the customer will bear the cost of returning the product toMenilmontant AP outside France or to French overseas departments and territories. 1. Legal information

The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act.
The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the law of January 6, 1978), which he/she may exercise by contactingMenilmontant AP. In addition,Menilmontant AP undertakes not to communicate, either free of charge or in exchange for payment, customer details to third parties.
